The Swiss Financial Market Supervisory Authority (Finma) has opened enforcement proceedings against a total of ten interlinked companies in Zug and two individuals. The authority made the surprising announcement on Tuesday evening.

According to Finma, there is a strong suspicion that the people involved in the proceedings as a group have carried out several activities that are illegal under financial market law without the necessary licenses.

According to the report, Finma has appointed an investigator and implemented measures to safeguard investors' interests.

Unclear Financial Situation

In addition to «Moonshot», the companies involved are likely to be the luxury apartment landlord «Le Bijou» and the initiators Alexander and Madeleine Hübner. 

The investigations revealed that the companies in question did not have up-to-date accounts. Accordingly, the financial situation of the companies is unclear, writes Finma.

No appeal has yet been lodged against these rulings.

Finma Justifies Intervention in Restaurant Project

In its statement, Finma also makes a rather unusual reference to media reports about the «Supernova» restaurant project in Bern. A few days before the opening, Finma ordered the closure of the restaurant.

The property is owned by the company OCSP, which is also affected by the enforcement proceedings. Finma states that there is a concrete suspicion the purchase of this property was financed using funds derived from activities that violate financial market law.

No Rental Agreement with «Supernova»

Finma emphasizes: «Contrary to what is sometimes reported in the media, there is no rental agreement between the operator of the ‹Supernova› restaurant and the owner of the property.»

Instead, the operator of the restaurant is basing her claims on a subletting agreement between herself and an individual directly affected by these enforcement proceedings.

Unlawfully Concluded

According to Finma, it has concrete indications that the sublease agreement may have been concluded unlawfully.
